TERMS AND CONDITIONS

1. OVERVIEW

By using this website operated by Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival," "we," "us," or "our"), you agree to these Terms and Conditions. Please read them carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least 21 years of age for handgun purchases or 18 years of age for long gun purchases, or the legal age of majority in your state of residence, whichever is greater. You also agree to abide by all applicable local, state, and federal laws and regulations with respect to your purchase and use of firearms and ammunition.

3. CONDITIONAL SALES

All firearms sales through our website are conditional and contingent upon the completion of all applicable federal, state, and local mandated steps, including but not limited to successful background checks, waiting periods, and additional documentation as required by law.

4. FIREARMS AND AMMUNITION SHIPPING RESTRICTIONS

We comply with all federal, state, and local laws regarding the sale and shipment of firearms and ammunition. All firearms transfers must be completed through a Federal Firearms License (FFL) holder in accordance with federal law. We do not ship firearms directly to customers.

4.1 STATE RESTRICTIONS

The following states have specific restrictions:

CALIFORNIA

Cannot ship high-capacity magazines or firearms with:

  • Pistol grips
  • Thumbhole stocks
  • Threaded barrels
  • Ammunition background checks required

MASSACHUSETTS

No firearms or ammunition shipments.

NEW YORK

Ammunition shipments to FFL only, or with valid ID shipped to ID address.

ILLINOIS

Restrictions on certain firearms and accessories.

CONNECTICUT

License/permit required for ammunition purchases.

NEW JERSEY

FOID and state ID required for ammunition.

RHODE ISLAND

License required for ammunition purchase.

MARYLAND

Restrictions apply. No ammunition to Annapolis.

WASHINGTON D.C.

No ammunition shipments.

AGE RESTRICTIONS

Must be 18+ for rifle/shotgun ammunition, 21+ for handgun ammunition.

5. SHIPPING POLICIES

  • Ammunition must be shipped separately from packages that contain firearms
  • No shipments to PO Boxes
  • Carriers have specific requirements we follow

6. PROHIBITED PERSONS

We do not sell firearms or ammunition to persons prohibited from possessing them under federal or state law, including:

  • Convicted felons
  • Persons convicted of domestic violence
  • Persons subject to restraining orders
  • Persons adjudicated as mentally defective
  • Unlawful users of controlled substances
  • Persons dishonorably discharged from the military
  • Persons who have renounced U.S. citizenship

7. SHIPPING DELAYS

Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival") is not responsible for shipping delays caused by carrier issues, weather conditions, compliance checks, or other circumstances beyond our control. Shipping timeframes are estimates only and not guaranteed.

8. SAFETY DISCLAIMER AND ASSUMPTION OF RISK

All firearms and ammunition are inherently dangerous instruments and should be handled only by responsible persons who have completed certified training in the safe handling and use of firearms or who have otherwise obtained necessary competency for the same level of safe handling and use.

You, the customer, assume any and all risk associated with the purchase and use of our products. Because Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival") has no control over how our products will be used, or who will be using the products after your purchase, Arrowhead Survival disclaims any and all liability for incidental or consequential damages to person(s) and/or property resulting from the use of any products sold by us.

8.1 SAFE FIREARMS HANDLING

  • Never place a loaded handgun in a holster or other carrying device without first testing compatibility and fit in an unloaded situation
  • Always double check that your handgun is unloaded, including that the chamber is empty
  • Always treat a firearm as loaded until you check and double-check its condition
  • For information about how to safely carry your handgun, refer to your handgun manufacturer's safety and instruction manual
  • The depictions of firearms on our website are for marketing and informational purposes only and should never be relied upon for safe usage

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival"), be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use or inability to use the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the service; (d) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service.

10. INDEMNIFICATION

You agree to defend, indemnify and hold harmless Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival") from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees and costs), resulting from or arising out of (a) your use and access of the Service, or (b) a breach of these Terms.

11. RETURNS AND REFUNDS

All returns must comply with federal, state, and local laws. Firearms requiring return must be shipped to our FFL. Please contact us directly for return authorization before shipping any product back.

11.1 RETURN POLICY

  • We offer a return policy for items within 10 business days of receipt
  • Items must be unopened and in original packaging for exchange, store credit, or refund
  • Returns must be made within 10 business days of RMA issuance
  • Items must be shipped back within 72 business hours of receiving the RMA or the customer forfeits their right to a return or refund
  • If the customer ships the item after the 72 business hour period, the customer has waived their right to a refund or replacement of the item(s) and they understand that Arrowhead Survival will not send back the item and it becomes the property of Arrowhead Survival
  • All returns are subject to denial at Arrowhead Survival's sole discretion for any reason

11.2 RESTOCKING FEES

  • A 35% restocking fee applies to all authorized returns
  • A 65% restocking fee applies to any returns due to a failed background check

11.3 SHIPPING COSTS

  • Customer must pay all return shipping costs
  • Shipping for returns should be tracked and insured
  • Customers are responsible for any lost or damaged items in transit
  • USPS tracking is limited and requires a 30-day wait for tracing lost shipments
  • Any shipping charges accrued by Arrowhead Survival will be deducted from the refund
  • All shipping charges are non-refundable

11.4 NON-RETURNABLE ITEMS

  • Custom orders
  • "As is" or "used" products
  • Installed or used items
  • Firearms/NFA items post-ATF paperwork
  • Food of any type
  • Ammunition
  • Optics
  • Barrels
  • Certain electronic devices
  • Sale or clearance items
  • Special order items

12. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are and will remain the exclusive property of Arrowhead Survival LLC and its affiliates, subsidiaries, parent companies, related entities, successors, assigns, officers, directors, employees, agents, representatives, and licensors (collectively, "Arrowhead Survival") and its licensors. The Service is protected by copyright, trademark, and other laws.

12.1 TRADEMARKS

All Arrowhead Survival logos, name, as well as the term "ass gun" and the donkey holding a gun are all trademarks of Arrowhead Survival LLC or its parent company Range Day Holdings. All other logos are trademarks of their respective owners. Unauthorized use of any of these trademarks is strictly prohibited without prior written permission from Arrowhead Survival LLC or its parent company.

13. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. It is your responsibility to check our website periodically for changes.

14. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Florida, without regard to its conflict of law provisions.

15. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. ENTIRE AGREEMENT

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

17. ACCURACY OF MATERIALS

The materials appearing on our website are not comprehensive and are for general information purposes only. Arrowhead Survival does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

18. LINKS

Arrowhead Survival has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval or control by Arrowhead Survival of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

20. ADDITIONAL TERMS FOR GUNSMITHING AND OTHER SERVICES

20.1 SCOPE OF SERVICES

These additional terms and conditions apply to but are not limited to the following work to be completed: Cerakote work, Gunsmithing work, Customizations, Repairs, Cleaning, Laser Engraving and any other services provided by Arrowhead Survival LLC.

20.2 MODIFICATIONS AND LIABILITY

  • Customer is informed, realizes, and understands that any alterations requested to be done to the Customer's gun may release the Manufacturer from any liability for any accident and may void manufacturer's warranties.
  • Customer recognizes and understands that by requesting these changes, Customer is releasing Arrowhead Survival from any liability should any accident occur because of the requested changes or alterations.
  • Customer will indemnify and defend Arrowhead Survival from all liability for any loss, damage, or injury to persons or property arising from or related to the performance of the agreement including all consequential damages whether or not resulting from the negligence of the Customer or Customer's agent.

20.3 TIMELINE AND COMPLETION

  • Customers understand that work may take up to and in excess of 30 days to complete.
  • Customers understand that due to unforeseen circumstances, work may take longer than 30 days. Arrowhead Survival does not guarantee any specific delivery date for any reason.
  • Any jobs left in the shop for more than 30 days after notification of completion will be sold to cover expenses if other arrangements have not been made.

20.4 PAYMENT TERMS

  • We accept cash, check, Visa, MasterCard, Discover, American Express and Credova.
  • The minimum charge is $55 (unless otherwise stated in the work order) for Arrowhead Survival to bring the firearm into their possession regardless of the work being or not being performed.
  • This charge is due at the time of picking up the firearm even if customer chooses to not have the work performed by Arrowhead Survival.
  • This charge will cover the first 30 minutes of work to diagnose the problem.
  • If customer pays by card or check and disputes the charge, the customer agrees to pay any and all fees associated with the dispute and any collection costs incurred by Arrowhead Survival.
  • There is a minimum non-refundable deposit of at least 50% due at the time of dropping off the items for work.
  • All amounts paid to Arrowhead Survival are NON-REFUNDABLE for any reason.
  • If a customer wishes to pick up their item(s) before completion of work, the customer is responsible for payment of the total amount owed on the bill prior to the item being picked up.

20.5 PICKUP AND TRANSFER

  • Arrowhead Survival only allows the Customer dropping off the item to pick up the item(s) being worked on.
  • Under no circumstances will Arrowhead Survival release these items to any other party.

20.6 GUARANTEE AND INSURANCE

  • We guarantee our work for 30 days on the job as described in the work order labor only.
  • Since the parts may be new or used, Arrowhead Survival does not guarantee the parts.
  • No insurance is provided by Arrowhead Survival for your firearms or parts due to theft, flood, or other act of nature, war, or any other reason.
  • The customer is responsible for insuring their firearm during the time it is in possession of Arrowhead Survival.

20.7 SHIPPING AND PARTS

  • Arrowhead Survival reserves the right to ship out any item to a contracted company.
  • Fees for shipping may be added to the final price in the event that shipping/transport costs exceed $15.
  • All parts needed for work must be supplied by the customer or customer parts will be ordered by Arrowhead Survival and placed on the work order to be charged to the customer.
  • Parts will be charged up to a 100% markup but no higher than MSRP.
  • Customer will also be responsible for any shipping costs and taxes.
  • In the event that Arrowhead Survival must research to find a part due to the unavailability or difficulty of finding the part(s) necessary to complete the job, the customer agrees to pay a research fee based on the current hourly rates and fees, no exceptions.

20.8 WORK ORDER TERMS

  • Complete work order terms will be returned once all costs are paid in full.
  • Arrowhead Survival will provide an assessment of all parts that are required for the work order to be completed; however, this is subject to change at any time.
  • If Arrowhead Survival determines the change in the parts required for completion to be material, then Arrowhead Survival will notify the customer prior to purchasing the parts.
  • If Arrowhead Survival determines the change in the parts required for completion to be immaterial and/or costing less than $50, then Arrowhead Survival will purchase the parts without customer approval and add them to the cost of the work order.
  • Labor prices may be quoted as a total or at an hourly rate as agreed upon by Arrowhead Survival and the customer.

20.9 RELEASE FROM LIABILITY

By requesting gunsmithing services, Customer acknowledges:

  • Customer has voluntarily requested Arrowhead Survival activities which include, but are not limited to, modifications and alterations to a gun or part of a gun/firearm that may affect various safety systems.
  • Customer is aware that alterations and modifications of guns may be hazardous, with potential dangers including death, dismemberment, and paralysis, and accepts any and all risks of injury or death.
  • As consideration for this gunsmithing being performed, Customer agrees not to make a claim against, sue or attach the property of Arrowhead Survival, or any of its affiliated organizations, members, managers, contractors or employees for injuries or damages resulting from the requested modification or alteration to a gun.
  • By paying for and/or picking up the firearm and/or parts, Customer acknowledges they have inspected the firearm and/or parts and approve of the work that was completed.
  • Customer understands there is no warranty for any work done after the firearm has left Arrowhead Survival's possession.

20.10 EXPRESS DENIALS OF WARRANTY

  • NO IMPLIED WARRANTY OF MERCHANTABILITY IS GIVEN AND IS EXPRESSLY DENIED.
  • NO IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS GIVEN AND IS EXPRESSLY DENIED.
  • NO IMPLIED WARRANTY OF WORKMANLIKE QUALITY IS GIVEN AND IS EXPRESSLY DENIED.

20.11 RATES AND EXPEDITED SERVICE

  • Current Hourly Rate: $95.00
  • Expedited Service Fee: $150 (non-refundable for any reason)
  • In the event of unforeseen circumstances, Arrowhead Survival does not guarantee that the work will be completed in under 30 days even with expedited service.
  • Arrowhead Survival will do everything in its abilities to complete the work in a timely manner.

20.13 DISASSEMBLY AND REASSEMBLY DISCLAIMER

  • Arrowhead Survival is not a gunsmith and does not provide professional gunsmithing services that involve disassembly or reassembly of firearms.
  • If a firearm is sent assembled, Arrowhead Survival is not responsible for any missing or damaged parts that must be removed for work to be completed.
  • By submitting a firearm for services, the customer expressly authorizes Arrowhead Survival to remove any parts necessary to complete the requested work.
  • Arrowhead Survival may, at their discretion, charge an hourly rate if the gun needs any parts removed.
  • In the event that Arrowhead Survival must engage the services of a qualified third-party gunsmith to disassemble or reassemble the firearm for Cerakote or laser engraving services, the customer will be responsible for the entire third-party gunsmith bill plus a 20% service and coordination fee (for example, if the third-party gunsmith charge is $100, the customer will be billed at the rate of $120).
  • Arrowhead Survival recommends that customers who are unfamiliar with proper firearm disassembly and reassembly techniques consult a qualified gunsmith before sending a disassembled firearm or requesting disassembly services.
  • Arrowhead Survival reserves the right to refuse service on any firearm that appears to be improperly assembled, damaged, or potentially unsafe to handle.

20.14 FIREARM CLEANLINESS REQUIREMENTS

  • The customer must provide their firearm clean and oil-free.
  • If the customer has questions about how to properly clean and prepare their firearm, they may ask Arrowhead Survival for guidance.
  • If the firearm is deemed to be excessively dirty, the customer will be responsible for the Dirty Firearm Fee of $150.
  • Arrowhead Survival reserves the right to determine, at its sole discretion, whether a firearm is excessively dirty.
  • The Dirty Firearm Fee covers additional cleaning labor and materials needed to prepare the firearm for the requested services.
  • Payment of this fee does not guarantee that all cosmetic imperfections will be removed from the firearm.

20.15 MODIFICATION OF TERMS

Arrowhead Survival reserves the right to change these terms and conditions at any time without notice.
